Just for arguments sake, let us suppose you were accused of an assault that took place twenty five years ago. You maintain your innocence, but cannot remember where you—or others who might exonerate you—were at the time. Worse, neither can they. Some are even dead.
We used to have a statute of limitations, a reasonable time frame “where affected parties need to take action to enforce rights or seek redress after injury or damage,” for these sorts of charges.1 After all, due process allows access to credible witnesses for the accused—ask the Duke LaCrosse team.
Especially if the charges leveled against you happen to bear a striking resemblance to an episode of ‘Law & Order,’ right down to the lingerie section at Bergdorf Goodman.2 Your accuser, who has filed similar charges against others with high profiles, admits awareness of the TV show, but says she didn’t see it.3
Oh, and the decades-old allegations were first aired in a 2019 New York Magazine excerpt of the plaintiff’s new book titled, “What Do We Need Men For?”4
